USA Painters Inc. ("Texas Painters," "we," "our," or "us") respects your privacy and is committed to protecting your personal information. This Privacy Policy explains how we collect, use, share, and protect information when you use our website, txpainters.com, and any related mobile, communication, or payment features (collectively, the "Platform"). By using the Platform, you consent to the practices described in this Privacy Policy and to our Terms of Use. If you do not agree with this Policy, please do not use our Platform.

2. Information We Collect

2.1 Information You Provide Directly

We collect both Personal Information and Non-Personal Information from users:

  • Account Information: When you register as a Client or Painter, we collect your name, email, phone number, password, and any other details you voluntarily provide.
  • Job Requests: When Clients submit a job request, we collect property details, addresses, photos, descriptions, and project preferences.
  • Painter Profiles: Painters may provide work photos, company names, license details, and descriptions of services.
  • Payments: When payments are made through Stripe, billing information (name, address, last four digits of card, etc.) is processed securely by Stripe. We do not store full credit card numbers or banking details.
  • Communications: We collect messages, quotes, and chats exchanged between Clients and Painters through our system.

2.2 Information Collected Automatically

When you use our Platform, we automatically collect:

  • Device and Browser Data: IP address, browser type, operating system, and device information.
  • Usage Data: Pages visited, session duration, and interaction data (clicks, scrolls, form activity).
  • Location Data: Approximate geolocation inferred from your IP or voluntarily provided zip code.
  • Cookies and Tracking Technologies: We use cookies and similar technologies to recognize you, improve the site, and serve relevant ads. See Section 6 below for details about cookies and advertising technologies.

3. How We Use Your Information

We use the information we collect for the following purposes:

  • To Operate and Improve Our Platform: Enable logins, bookings, quotes, and communication between Clients and Painters. Maintain account security and troubleshoot technical issues.
  • To Process Payments: Facilitate secure payments and refunds through Stripe. Prevent fraud or misuse of payment systems.
  • To Communicate with You: Send project updates, confirmations, and responses to inquiries. Deliver administrative notices, invoices, and policy updates.
  • To Personalize the User Experience: Tailor job recommendations and pricing simulations. Show localized or relevant Painter options.
  • To Conduct Analytics and Advertising: Analyze Platform usage to improve performance. Serve targeted ads through Meta, Google, and other networks (see Section 6).
  • To Comply with Legal Obligations: Maintain transaction records for tax and accounting purposes. Cooperate with law enforcement or regulatory requests when required.

4. Legal Basis for Processing (for U.S. and International Users)

We process your personal data only where permitted by law, including:

  • Your consent (e.g., when you opt-in to marketing communications).
  • To perform a contract (e.g., fulfilling a service request or processing payments).
  • To comply with legal obligations (e.g., tax or fraud prevention).
  • For legitimate business interests, such as improving the Platform and ensuring safety.

5. How We Share Information

We do not sell your personal information. We may share data in the following limited circumstances:

  • With Painters and Clients - to enable the exchange of quotes, messages, and bookings.
  • With Service Providers - including:
    • Stripe (payment processing)
    • Google Analytics / Tag Manager (traffic and performance analytics)
    • Meta Platforms, Inc. (advertising and conversion tracking)
    • Hotjar Ltd. (heatmaps, session recordings)
  • For Legal Reasons - if required by law or to protect rights, safety, or property.
  • In a Business Transfer - if we merge, sell, or transfer assets, user data may be part of the transaction.

All third-party processors are contractually required to handle your data securely and only for the purposes described above.

6. Cookies, Tracking, and Advertising Technologies

We use cookies and similar tracking tools to:

  • Recognize repeat visitors;
  • Understand how users interact with our Platform;
  • Personalize content and ads; and
  • Measure advertising performance.

7. Payments and Financial Information

All payments are processed by Stripe, Inc. Stripe handles and stores all card data in accordance with PCI-DSS standards. We do not directly store or access payment card details. By using the Platform, you also agree to Stripe's own privacy policy: https://stripe.com/privacy

8. Data Retention

We retain user information only as long as necessary to:

  • Provide our services and maintain user accounts;
  • Comply with legal, accounting, or tax obligations; or
  • Resolve disputes and enforce agreements.

9. Security

We implement commercially reasonable safeguards including HTTPS encryption, firewalls, and secure server infrastructure. However, no method of transmission over the Internet is completely secure. By using our Platform, you acknowledge these inherent risks.

10. Your Rights

You may:

  • Access or update your account information;
  • Request deletion of your account;
  • Opt out of marketing communications by clicking "unsubscribe" in any email.

11. Children's Privacy

The Platform is not directed toward individuals under 13. We do not knowingly collect personal information from children. If we discover that such data has been collected, it will be promptly deleted.

12. Links to Other Websites

Our Platform may link to external sites (e.g., suppliers, partner painters, or social media). We are not responsible for the privacy practices of these third-party websites. We encourage you to review their policies before providing personal information.

13. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. The "Last Updated" date at the top of this page reflects the most recent revision. If significant changes occur, we will notify users via email or a prominent notice on our website. Continued use of the Platform after such updates constitutes your acceptance of the revised Policy.
